These Terms & Conditions ("Terms") govern your use of TAIPAN! (the "App"), published by A. Gacutan ("we," "us," or "our"). By downloading, installing, or playing the App, you agree to these Terms. If you don't agree, the only winning move is to not install the App — no hard feelings, Taipan.

1. Acceptance of Terms

By accessing or using TAIPAN!, you confirm that you accept these Terms and agree to comply with them. These Terms apply to all users of the App, regardless of how rich or how deeply in debt your in-game Taipan currently is.

2. License to Use the App

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use TAIPAN! on devices you own or control, strictly for your own personal, non-commercial entertainment. You may not:

  • Copy, modify, distribute, sell, or lease any part of the App;
  • Reverse-engineer or attempt to extract the source code, except where applicable law permits it;
  • Use the App for any commercial purpose without our prior written consent;
  • Remove or obscure any copyright or proprietary notices.

3. Game Center & Online Features

TAIPAN! integrates with Apple Game Center for leaderboards and achievements. Your use of Game Center is also governed by Apple's own Game Center Terms and your Apple ID account settings. We don't control, and aren't responsible for, Game Center's availability, accuracy, or uptime. If Li Yuen's fleet is more reliable than the leaderboard that day, that's between you and Apple.

4. User Conduct

You agree to use the App lawfully and not to use any bugs, exploits, or unauthorized third-party tools to manipulate leaderboard standings or achievement data. We reserve the right to reset or remove Game Center data associated with your account if we reasonably believe it was obtained through such means.

5. Historical Setting Disclaimer

TAIPAN! is set in a fictionalized version of the 1860s China coast trade era and references historical goods, including opium, as a gameplay mechanic. This content is presented for historical and entertainment context only. Nothing in the App endorses, encourages, or glorifies the real-world opium trade or any illegal activity. Because a single run can span your Taipan's entire career, several ports' skylines also depict wartime destruction and rebuilding, including the WWII era. This too is presented for historical and entertainment context only.

6. No Warranty

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including (without limitation) implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the App will be error-free, uninterrupted, or compatible with every device — much like a 1860s clipper ship, it mostly works, but the seas are unpredictable.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the App — including any in-game net worth, achievements, or Captain's Log entries lost due to app deletion, device loss, or the tides of fate. Our total liability for any claim relating to the App will not exceed the amount you paid for it (which, if the App is free, is a comfortingly small number).

8. Third-Party Services

The App relies on services provided by Apple Inc., including the App Store and Game Center, which are governed by Apple's own terms and privacy policies. Your use of those services is between you and Apple.

9. Changes to These Terms

We may update these Terms from time to time to reflect changes in the App, legal requirements, or just general tidying up. We'll update the "Last updated" date above when we do. Continued use of the App after changes take effect means you accept the revised Terms.

10. Termination

We may suspend or terminate your access to App features (such as Game Center integration) if you violate these Terms. You may stop using the App at any time by deleting it — just know that, as noted in our FAQ, your local save data goes down with the ship.

11. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any disputes will be resolved in a court of competent jurisdiction within the United States.
